Limits of use and liability
All products are intended to be used by private gardeners rather than commercial growers or businesses. In good faith we take every care to ensure that the description, illustration, packet contents, instructions and products are accurate and fairly represented but cannot be liable for any direct or consequential loss or damage resulting from any errors, beyond replacing the effected goods or refunding the actual purchase price. Live product may give varying results under different growing and seasonal conditions.
If your products arrive in poor condition or are damaged, please notify us within 7 days and we will arrange for a replacement (if possible) or a full refund. We regret that we cannot replace, or refund products effected by adverse weather conditions, pests or diseases. Upon delivery, if you decide you no longer require the item, it must be returned to us undamaged and in its original packaging, at your cost before we will issue a refund. Your statutory rights are not affected.
Sold Outs
Occasionally, because of high demand or crop failure, a variety maybe oversold. Where this happens, we will endeavour to substitute a variety of similar merit of equal or greater value or offer you a refund if there is no alternative.
Despatch Dates
Despatch dates are given as a guide only and represent the beginning of the despatch period. Some seasonal items can be despatched across several weeks and we always despatch oldest orders first, once items are in stock. Factors outside of our control, such as weather conditions or light levels, may affect live product growth rates and may cause delivery dates to vary.
UK Postage
Postage and packing (p&p) is applied in conjunction with the type of product you are ordering (e.g seed postage and packing is less than postage packaging for potatoes). This will be shown in your order before you proceed to order processing. Please refer to the order form of your latest catalogue for our current Postage and Packing (P&P) charges, we reserve the right to change or amend these at any time. You will only pay once for delivery, no matter how many different deliveries we make to you. P&P charges are incurred in full against the first item despatched from your order and will only be refunded if the whole order is cancelled or refunded.
Overseas Orders
We regret that we can no longer accept any orders for delivery outside of the UK mainland for any products including seed. We reserve the right to cancel and refund any orders inadvertently accepted for delivery outside of the UK, which includes Northern Ireland.
Prices & Special Offers
We reserve the right to amend prices or offers according to circumstances at any time. VAT is included where applicable. Free seed offer limited to one per household and are subject to availability. Free seed label quantities are supplied at our discretion. We regret that we cannot resupply free seeds or labels if they are missing from your order. Money off and discount vouchers are strictly limited to one per household, we reserve the right to cancel and refund any order, even if accepted and processed, if we subsequently discover that a discount or special offer has been misused.
Payment Policy
All goods including seasonally despatched products must be paid for at time of ordering.

Waste Electrical & Electronic Equipment (WEEE) Directive
The EU has introduced legislation relating to recycling "Waste Electrical and Electronic Equipment" ("WEEE"). Currently, most WEEE is disposed of with general domestic waste and is land filled. Separate collection allows WEEE to be recycled; this saves energy and resources and avoids hazardous materials from WEEE going to landfill. On new items of electronic equipment which you buy you will see the symbol:
This symbol means that you should not dispose of this product in your dustbin with your mixed domestic waste. You should dispose of this product separately.
Under these regulations we are obliged to offer our customers free take-back of their WEEE on a like-for-like basis when they buy a new electrical or electronic product from us. Such items can be returned to us (carriage paid by the customer) at our normal address, within 28 days of purchasing the new item. Please mark these items "WEEE return". We will then ensure proper environmental disposal. In helping to separately collect WEEE you will ensure that recycling, as required by the WEEE Directive, takes place and the amount of WEEE being land filled is reduced thereby helping to improve the environment.
Modern Slavery & Human Trafficking Statement
Introduction
This statement is made on behalf of D.T. Brown pursuant to section 54(1) of the Modern Slavery Act 2015 and comprises our slavery and human trafficking statement.
This is D.T. Brown's first statement under the Modern Slavery Act 2015. It outlines the steps taken as a business to identify and prevent slavery and human trafficking in our operations and supply chains. We understand our responsibilities and are committed to improving our practices to combat slavery and human trafficking.
The Business
D.T. Brown is a leading direct to consumer gardening brand, providing horticultural seeds and related products including live young plants. The principal activities being sourcing, packing and distribution.
The UK operations are headquartered in Newmarket, where employment practices are rigorously controlled by our internal Human Resource department to standards well above those set out in statutory legislation. Contractors, workers and agency staff are also rigorously audited in view of the Modern Slavery Act 2015.
Supply Chains
Our supply chains are global and offer us the biggest challenge, so have been the first external focus of attention in the year 2020. Based upon risk assessments, our highest risk and largest suppliers are audited via a combination of online audits and supplier visits. D.T. Brown commits to extend the scope of these annual audits.
Our Policies on Slavery and Human Trafficking
D.T. Brown's Anti-Slavery and Human Trafficking policy reflects our commitment to acting ethically and with integrity in all business relationships and to implementing and enforcing effective systems and controls to ensure slavery and human trafficking is not taking place anywhere in our business and supply chains. Our whistleblowing policy provides a system for employees to escalate slavery and human trafficking issues and breaches of our policy. The policy is reviewed annually in line with the changing business.
No breaches or suspected breaches have been reported in the financial year 2020.
Due Dilligence Processes For Slavery and Human Trafficking
To identify, monitor and mitigate risk is the responsibility of the Board of Directors, aided by the Human Resource department.
A target for the coming year is to increase the reach and coverage of this due diligence via a process of communication and training of the senior management team to further identify potential risks of modern slavery.
Statement
This statement is made pursuant to section 54(1) pf the Modern Slavery Act 2015 and constitutes D.T. Brown Slavery and Human Trafficking statement for the financial year end 30th June 2021 and was approved by the Board of Directors on 1st July 2021.
